But as I understand what the gentleman is saying, if there is a legitimate legal or policy dispute in the eyes of a local school district and ultimately its governing board and its top administrators, and if that dispute is between Federal and State law, it seems to me by definition that is an issue that has to be adjudicated in the courts. That is why I am saying to the gentleman that if the court does adjudicate that matter, and if the court does issue an order that says for all intents and purposes Federal law supersedes State law, takes precedence over any provisions in the State law or the State Constitution, I could live with that decision and I would be happy to reflect that in the bill. Mr. Chairman, I cannot go along with a provision that is so broad as to say 'Federal law generally.' Again, it seems to me that the very purpose of the judicial branch, the third branch of government, is to adjudicate a dispute between Federal and State law.
