The text of the amendment is as follows: Add at the end of subtitle F of title VIII the following new section: SEC. 8__. PROHIBITION ON CONTRACTING WITH EMPLOYERS THAT VIOLATED THE NATIONAL LABOR RELATIONS ACT. (a) Prohibition.--Except as provided in subsection (b), the Secretary of Defense may not enter into a contract with an employer found to have violated section 8(a) of the National Labor Relations Act (29 U.S.C. 158) during the three-year period preceding the proposed date of award of the contract. (b) Exceptions.--The Secretary of Defense may enter into a contract with a employer described in subsection (a) if-- (1) before awarding a contract, such employer has settled all violations described under subsection (a) in a manner approved by the National Labor Relations Board and the employer is in compliance with the requirements of any settlement relating to any such violation; or (2)(A) each employee of such employer is represented by a labor organization for the purposes of collective bargaining; and (B) such labor organization certifies to the Secretary that the employer-- (i) is in compliance with any relevant collective bargaining agreement on the date on which such contract is awarded and will continue to preserve the rights, privileges, and benefits established under any such collective bargaining agreement; or (ii) before, on, and after the date on which…
