I just want to go over a couple of points relating to the Brennan Center for Justice letter of September 22. First of all, the Senator from Kentucky made a statement a few days prior to the release of that letter on national television. He said something to the effect as follows: Russ does not have one single constitutional scholar who supports his position. So I can understand the Senator from Kentucky being a little tender about a letter signed by 126 constitutional scholars that says exactly what it says. I would first like to ask the Senator from Kentucky if he ever heard any of us, either at the news conference or otherwise, purport that that letter included references to the issue of issue advocacy versus express advocacy? I want to commend the Senator from Wisconsin for bringing that up, because it proves precisely my point, that the constitutional scholars are not certifying to the constitutionality of the issue advocacy or independent expenditure provisions of the bill.
