Mr. Speaker, reclaiming my time, the judge has that discretion under current law, has that discretion under this bill, but they don't have the discretion to say they are not going to award any damages where the case is found to be frivolous and, in fact, damages have been incurred. Obviously, the judge has a discretion to determine what those actual damages are, but he doesn't have the discretion to simply say: I am not going to award damages, even though I found the case to be frivolous.
