Not only did the judge rule that the CDC went beyond its authority, they also found that they violated the APA.
This is a violation of the Constitution, and I think it demonstrates the neglect of this administration to its responsibilities under the Constitution to protect those rights of the citizens.
So I think what we are seeing here is a broad misinterpretation of the statute and a mis-application.
