He used the recess appointment power at a time when the Senate wasn't in recess.

The D.C. Circuit said the appointments, including Ms. Block's, were unconstitutional.

This summer, the Supreme Court unanimously said it was unconstitutional.

The President ignored our request and appointed Ms. Block along with two other individuals to the NLRB in January 2012.

We should strive to have more Americans with a college degree.

The Federal Government plays a limited role. States must lead the way.

We have to simplify, which means getting rid of some options.

I think many Senators really aren't aware that the law limits the ability of institutions to counsel students about over-borrowing, which is something we should change.

I would welcome having those ideas.

During the Great Recession after 2008, because of the maintenance of effort requirement on States, Medicaid funding went up 15 percent in the State of Tennessee, higher education funding went down 15 percent.

We do find significant violations at some institutions with the statistics.

How can you do that?

I think we should carefully consider, not just in this case but in other cases, whether it's FDA or anything else, what the difference is between a law and a regulation which is proposed by the Department of Education.

Is that because in the past you have really failed to coordinate and have created a good deal of confusion on college campuses about how to coordinate the responsibilities for dealing with sexual assault as they look up at title IX and…

I'm very concerned about the arbitrariness of an individual in the Department saying what the law is when I thought we were supposed to do that.

Why would you not go out and ask institutions and people who might have been assaulted what they think about your guidance?

You require 6,000 institutions to comply with this, correct?

I just wanted to say before I leave how much I appreciated what each of you had to say and how really human it is to me to hear you say it personally.

I would welcome that, particularly based upon your study of it.

I'm concerned about the Obama administration's proposed regulation on overtime for home care workers.

That's not only good public policy. It makes fiscal sense.

I support giving the States more flexibility.

I hope during the hearing we'll talk about ways to create more jobs.
