Mr. Chairman, I have an amendment at the desk. The CHAIR. The Clerk will designate the amendment. The text of the amendment is as follows: Page 1, line 17, before the last period insert ``, except that this subsection shall not apply to a State if, upon request from the Governor of the State, the Secretary finds that the State's existing program exceeds the standards established by such rule regarding excess spoil, coal mine waste, and buffers for perennial and intermittent streams''.
