That is acceptable, provided those on the floor can muster a no which either exceeds the ayes or is so recognized by the Chair to be the predominant voice vote. I call for the question on a voice vote. The PRESIDING OFFICER. The question is on agreeing to the motion to waive the Budget Act in relation to amendment No. 2223. In the opinion of the Chair, the motion has failed and the Senate has not obtained the three-fifths majority necessary for passage. The point of order is sustained, and the amendment falls.
