Well, since that is the purported intent of the legislation of the Senator from Arkansas, then the sale of the generic could not be made until the court had determined that there was a substantial investment. It is my understanding that the substitute proposed by the distinguished Senator from South Carolina, Senator Thurmond, in collaboration with the distinguished Senator from Utah, Senator Hatch, would do the same thing. The substitute would not accept the filing, but would require the generic manufacturer to go to court and satisfy the court that there had been a substantial investment. Is that not the effect of the legislation of the Senator from Utah?
