This high-profile, well-publicized incident could prompt Congress to go too far. In some areas of this bill, we did go too far. This second-degree amendment fixes that. While I fully support the underlying Brownback legislation, I am offering this second-degree amendment to protect the interests of small broadcasters that should not be punished for the events outside of their control. In the case of the Super Bowl, for example, many affiliates were furious their viewership was exposed to such a spectacle. The amendment I offer simply calls on the FCC to consider the size and revenues of the stations in question, as well as whether they had anything to do with producing the offensive content in question.
