The Congressional Quarterly House Action Report on this legislation states the following: that the measure, however, exempts such restrictions for assistance for the Bashir nuclear reactor in Iran which is being developed with the aid of Russian entities unless the President determines such assistance is contributing to Iran's development of nuclear weapons. Now, that is very interesting because what that means is that it is not axiomatic that the mere presence of nuclear power capability necessarily means that Iran is developing nuclear weapons. As a matter of fact, you wouldn't have that provision unless the President had the authority to be able to make a finding with respect to the development of nuclear weapons by Iran.
