I think if we were to ask either the Republican or the Democratic nominees for President and Vice President that are out there running, all of them will say, no, I do not like frivolous litigation. The problem here is that my colleagues just do not want to be confused by the facts, because this bill is going to do more to encourage frivolous litigation, potentially, than it is going to do to discourage frivolous litigation. The Judicial Conference of the United States has made that clear in the letter that has been introduced into the Record in which they say that the provisions of this bill, which go back to the rules that were in effect prior to 1983, those rules were changed because they spawned a whole cottage industry of litigation related to frivolous lawsuits.
