the FDA defense is simple and it is fair. If the Food and Drug Administration approves a drug, then the pharmaceutical company which manufactures that drug should not be liable for punitive damages. Currently the fear of unnecessary litigations stifles innovations and limits the types of drugs which are available to the American consumer. Without the FDA defense, beneficial drugs will be driven out of the marketplace and manufacturers will continue to be discouraged from developing new drugs to treat illnesses such as AIDS and cancer. I urge my colleagues to support the amendment.
