The situation that needs to be cured is not that the statute preempts negligence claims requires a change. The situation needing remedy is the misinterpretation of the statute by some courts. That is precisely what this clarifying language is intended to accomplish. This matter will be further reviewed as we proceed with reauthorization of the Federal Rail Safety Act in our Committee on Transportation and Infrastructure, and I would look forward to continuing to work with the gentleman from North Dakota, the Chair of the subcommittee, and ranking member of the subcommittee to address the judicial interpretation.
