The consent order settlement agreement contains a provision that, except for a narrow exception for the treatment of graphite fuel from the Fort St. Vrain reactor in Colorado, the Department of Energy will make no shipments of spent fuel from commercial nuclear powerplants to the Idaho National Engineering and Environmental Laboratory. Therefore, selection of Idaho for further commercial fuel storage would be inconsistent with and in violation of the consent order.
