I would respectfully argue that the amendment is core to the proper functioning of the underlying bill. The amendment's purpose is the same purpose as the underlying bill: it is to facilitate the replenishment of the SPR for the exact drawdowns covered in the bill. The amendment furthers the objective of the underlying bill. In fact, it is arguably inextricably linked and indispensable to the purpose of the bill in so far as producing more oil and gas requires access to capital for those producers of oil and gas. Mr. Chairman, you can't produce oil and gas if you can't get financing for it. That is why I respectfully oppose the point of order. The Acting CHAIR. Does any other Member wish to be heard on the point of order? If not, the Chair is prepared to rule on the point of order. The gentleman from New Jersey makes a point of order that the amendment offered by the gentleman from Kentucky is not germane. The clause 7 of rule XVI, the germaneness rule, provides that no proposition on a subject different from that under consideration shall be admitted under color of amendment. The bill prohibits the drawdown of petroleum products in the Strategic Petroleum Reserve until the Secretary of Energy has developed a plan to increase the percentage of certain Federal lands leased for oil and gas production. The amendment would address rules issued by financial regulators. The Chair finds that the amendment goes beyond the subject matter of the underlying bill.…
