the Omnibus Appropriations Act, H.R. 4328, includes under the Labor/HHS portion of the legislation a title IX which may be cited as the Women's Health and Cancer Rights Act of 1998. In general this act amends both ERISA and the Public Health Services Act (within the scope of coverage of such Acts as established in HIPAA) to require group health plans and health insurance issuers that cover medical and surgical benefits for mastectomy to also include in their scope of coverage: (1) all stages of reconstruction of the breast on which the mastectomy has been performed, (2) surgery and reconstruction of the other breast to produce a symmetrical appearance; and (3) prostheses and physical complications of mastectomy, including lymphedemas, in a manner determined under the terms of the plan or health insurance coverage in consultation with the attending physician and the patient. The described coverage may be subject to annual deductibles and coinsurance as deemed appropriate and consistent with those established for other benefits under the plan or health insurance coverage under which an individual is enrolled.
