“The issue here is very simple. As I understand the Johnson-Duncan amendment, it simply says that if a school receives Federal funds that it should, as part of its tutorial role, ensure that students have the full range of constitutional rights. There are all kinds of issues that come up, for example, dress codes, the manner in which students can publish newspapers, that went to the Supreme Court. And teachers and schools deal on a day-to-day basis with the rights of students. My understanding of the Johnson-Duncan law is, all it says is that students are entitled to constitutional rights and, to the extent that schools are receiving Federal funding, they should be guarding the constitutional rights of those children.”
