I wanted to set the record straight on a matter that was brought up late last night with regard to me and my questioning of Judge Kavanaugh and his relationship to Judge Kozinski.
Judge Kavanaugh, why do you rarely dissent on behalf of consumers, workers, or the powerless?
Your view is that Native Hawaiians do not deserve protections as indigenous people under the Constitution.
I think that my colleagues from Alaska should be deeply troubled by your views.
They do not have their own government. They do not have their own elected leaders. They do not live on reservations or in territorial enclaves. They do not even live together in Hawaii.
Perhaps if all those situations or those processes had been in place over the 30 years that Judge Kozinski was engaging in this kind of behavior, maybe he would have stopped, but he did not.
Judge Kozinski's behavior was egregious and pervasive. It went on for more than 30 years.
