“What it does is it changes the provision if an alien is to be deported. Under the present bill, if there is classified information that alien is not informed of anything. That is a clear violation of due process and I think the courts would toss it out. What we have suggested, and we are working on the precise language now, but what we are suggesting is that the Attorney General would provide an unclassified synopsis and the court would have access to the classified information to make sure the unclassified synopsis is accurate. And then that would be given to the person who is charged with being deported. That gives some reasonable access. We provide for review and appeal procedures. We are still working on some details. Senator Specter may want to comment on this. We may offer the amendment tomorrow or later tonight, I am not sure, but I think we are very close to an accord. I might add the accord is in line with the original draft of the legislation that is before us. But I think the legislation, if it is not amended, frankly, the courts would toss it out as violating due process.”
