Amendment offered by Mr. Riggs: Page 102, after line 24, insert the following new section: Sec. 516. (a) Limitation on Use of Funds for Admissions Preferences in Public Education.--None of the funds made available in this Act may be used by the Department of Education to withhold any financial assistance, or to impose, administer, or enforce any other penalty, sanction, or remedy, for the refusal or failure of a Federal grant recipient to enforce a preference or affirmative action plan based on race, sex, color ethnicity, or national origin for admissions to public educational institutions. (b) Applicability.--The limitation established in subsection (a) shall apply only to Federal grant recipients located in a State in which the enforcement of such preference or plan is prohibited by the laws of the State or by an order of a Federal court.
