If the Constitution says 51 votes, or a simple majority, I am asking if it would be an effort to go around the Constitution to filibuster a Federal judge. Is it even really seemly to filibuster a Federal judge nominee when the Constitution is very clear on this issue? Is it setting a new standard with Miguel Estrada that we are going to all of a sudden have the Constitution averted to start requiring 60 votes out of 100 to confirm a Federal judge, a nominee, which is the President's absolute right to make, his right and responsibility, and he has nominated these qualified judges?
