Small businesses have been hit hard in the last 4 years by rising costs, supply chain problems, and heavy regulations. These businesses, which make up a large part of America's economy, often bear the brunt of new Federal rules and regulations implemented by the Biden administration. The Prove It Act, H.R. 7198, is designed to help small businesses push back when Federal agencies don't follow the rules laid out in the Regulatory Flexibility Act, or the RFA. This bill gives small businesses the power to challenge proposed regulations if an agency hasn't fully or accurately considered how those rules would affect them. It also requires agencies to consider indirect costs when conducting a regulatory flexibility analysis, publish any follow-up guidance to the rule online, and periodically review the rule to ensure it still makes sense. If the agency does not adhere to these requirements, small entities are exempt from complying with the rule. It is about time. While agencies are already required by the RFA to do this type of analysis, they are not required to make it public. The Prove It Act changes that, adding transparency and accountability to the process. If they are doing this analysis correctly, then there should be very little additional burden and no concern in making it public.…
