The GEB's decision is consistent with the Court's statement on the record on June 29, 1998 that voluntary payment by IBT officers of the costs of supervision would be a "breach of a fiduciary relationship and something that is forbidden actually to do by law." The thought occurred to me that the union could send a message to the IBT hierarchy that they would agree and it would not be considered by them a breach of a fiduciary relationship if they were voluntarily to agree to contribute some money to a rerun election. However, the memorandum is very persuasive that the cost and the effort involved in such an undertaking would be futile. So my good intention has come practically to naught.
