When I was in the State Senate of Virginia, we dealt with the issue and gave the defendant an opportunity to be heard so that we are not imposing this test on innocent individuals. The gentleman mentioned that there is confidentiality within the medical situation of the results of the test. The fact of the matter is that in the bill, the information is divulged not just to medical personnel but to the victim, the defendant, the attorneys for the victim, the attorneys for the defendant, the prosecuting attorneys, and the judge presiding at the trial.
