When the Committee on Rules filed its report (H. Rept. 113-187) to accompany House Resolution 322 the Committee was unaware that the waiver of all points of order against consideration of H.R. 2879 included: A waiver of clause 9(a)(2) of rule XXI , prohibiting consideration of a bill or joint resolution not reported by a committee, unless the chair of each committee of initial referral has caused a list of congressional earmarks, limited tax benefits, and limited tariff benefits in the bill or a statement that the proposition contains no congressional earmarks, limited tax benefits, or limited tariff benefits to be printed in the Congressional Record prior to its consideration. The required statement from the chair of the Committee on Oversight and Government Reform, the primary committee of jurisdiction, was printed in the Congressional Record dated July 31, 2013. However, the required statement from the chair of the Committee on the Judiciary, which also received an additional referral, was submitted for printing on August 1, 2013. Both statements provide that H.R. 2879 does not contain any congressional earmarks, limited tax benefits, or limited tariff benefits.…
