“It is not unreasonable to have somebody who does not own your land, has no real business on your land, ask permission to come on your land. That is an absolute subrogation of the rights guaranteed under the Constitution which we are now embracing and say it is fine to not have to get permission. That is not what comes with property rights under the Constitution. If our defense is we do not believe in the Constitution and the rights of private property rights, then I would say we are misguided in what we are doing. This is a simple way of saying, if we are going to have heritage areas and if I am a private property owner in a heritage area and you want to come on my property and survey, you ought to have to get my permission. You should not be able to come on my land without permission to do so.”
