Of course, that whole discussion suggests the Founders were a little smarter than we gave them credit for. There is nothing in the Constitution that justifies the creation of a Federal Department of Education in the first place. It was, I think, more of a concession to the NEA teachers union. And I am not sure if they got a very good deal anyway.
