that is, of course, the order. I thank the chairman for correcting us in that because we are operating on the broader bill, the underlying bill, under a UC. This amendment was brought forth with the hope that both sides could accept it. Our side has accepted it. I worked with the ranking member, Senator Levin, to resolve a couple of issues in it that I think can be accepted. In that case, I hope it will appear in the managers' amendment. We would include in the amendment--and we are discussing those who are eligible to be buried in military cemeteries. We have a prohibition now against those with a Federal capital offense lying at rest in our military cemeteries. We found this summer that an individual who had been convicted of murder in two instances in Maryland, serving his life sentence in a Maryland prison, died and was buried in Arlington. We want to correct that by saying that Federal or State law, where the final decision--he is found guilty even under appeal--it has to be a final decision in that instance, and that under extraordinary circumstances, even though he might be convicted, a Governor or a President would commute the sentence. That would be the exception. I would be willing to agree to those two items to be included in the amendment if that is acceptable to all parties, and we would so craft it that way.
