When we reauthorize the Endangered Species Act, we can certainly address those problems that have happened. When we reauthorize the Clean Water Act, we can do that for wetlands. This Porter amendment makes sure, it reemphasizes, it directs the agencies so that they will be told by us and we have the responsibility, that you must inform that person as far as the impact of their property is concerned and the value of their property whether it is diminished or whether it is not diminished. The fifth amendment still holds true. But my problem with this bill as it stands without the Porter amendment is that in my mind it is going to create a huge, litigating, bureaucracy that we cannot anticipate.
