I am pleased that the mark-to-market legislation that is incorporated in the VA-HUD conference report contains some measures that deal with properties that are disqualified from the restructuring program. I believe that it is critical that flexibility is provided to the participating administrative entity [PAE] and HUD in dealing with disqualified properties. I am, however, concerned about those properties that are not part of the mark-to-market program but are disqualified from the renewal process.
