Mr. Chairman, this resolution deals with the President's Task Force on National Health Care Reform. That task force was concerned about quality health care for the people of this country. It dealt with many subjects, including how to expand health care insurance for many Americans who had no health care insurance, and it was also deeply concerned about quality standards and consumer protection for people who are in managed care programs. Each of us have heard from our constituents their concern that the practice of medicine, the medical decisions are being made by bureaucrats rather than by medical professionals. The United States District Court ruling that is the subject matter of this resolution awarded attorneys' fees for some physicians who challenged the work of that task force. This sense of Congress resolution says that those attorney fees should not be paid for by taxpayer funds. As the gentleman from California (Mr. Campbell) pointed out, the law says that attorneys' fees can only be paid for by the government, and, therefore, if this sense of Congress resolution was carried out, if we made it law, as my friend the gentleman from California (Mr. Stark) pointed out, the plaintiffs in that lawsuit would not be able to recover any attorneys' fees, which is certainly contrary to the intent of the sponsors of this resolution. That is why this sense of Congress resolution makes no sense.
