This amendment expresses the sense of Congress regarding the continued intransigence of North Korea in refusing to comply with the terms of the Nuclear Non-Proliferation Treaty. For nearly a year, North Korea has refused to allow access to its nuclear-related facilities, as required under its safeguard agreements with the International Atomic Energy Agency. The International Atomic Energy Agency has not formally declared a break in the continuity of safeguards on nuclear-related facilities in North Korea, but inspections have not been permitted since last January. This raises serious questions as to the possibility of diversion of nuclear material to a weapons development program--a situation which cannot be permitted to stand unchallenged and unexplored.
