Mr. Chairman, the Watt amendment is attacking the words ``used as intended'', and he has sort of indicated that those words are vague and perhaps they should be deleted because the courts could not quite understand them. I have Black's Law Dictionary back in my office, Mr. Chairman. I went up and looked up the words. It is defined as ``the intended use doctrine,'' defined as ``The rule imposing a duty on a manufacturer to develop a product so that it is reasonably safe for its intended or foreseeable users.'' In fact, if we look up the words ``used as intended,'' for example, the words ``manufacturing defects'' or ``design defects,'' any of these terms which, at first glance, would connote some nebulous concept. Indeed, it is not a nebulous concept; there is a strict interpretation of these words in tort law. In Westlaw, which is a commonly used legal database, if we go into that and put in the words ``used as intended,'' we come up with that it has been cited in 1,300 State cases and over 900 Federal cases come up. That is ample guidance for courts to use regarding what ``used as intended'' means in a case alleging defective design or manufacture.
