How do you arrive at that objectively? I heard you say a moment ago it was based on what the jury ultimately decides as to whether or not there was ultimate merit. Do you not contemplate excellent litigants being on the defense side or plaintiff's side being more persuasive or jurors that are quirky or judges who are stupid, or do you not contemplate any of those things?
