“I would just note that all of the modern cases that I have been able to find in the spousal immunity area that would be the guide in the parental/child immunity cases do make exceptions for criminal activity. I would note also that in the case cited by our colleague, the Kaczynskis, I would join in his admiration of the Kaczynski family that came forward under very trying circumstances and did the right thing and did save lives, and they did it voluntarily. I believe, had they relevant evidence, clearly that since they came forward with the evidence, they would have testified.”
