Mr. President, I want to for a couple minutes comment on the bill and then make a unanimous-consent request that the amendment I will offer be in order and that other amendments be laid aside. But first a moment or two of commentary. The bill before us, S. 397, says that its purpose is ``to prohibit civil liability actions from being brought or continued against manufacturers, distributors, dealers, or importers of firearms or ammunition for damages, injunctive or other relief resulting''--and here are the keywords--``from the misuse of their products by others.'' On page 3, in section 2, findings and purposes, finding No. 6 is: The possibility of imposing liability on an entire industry for harm that is solely-- And that is the keyword-- solely caused by others is an abuse of the legal system. . . . I happen to agree with that. If harm is solely caused by others, it would be an abuse of the legal system to impose liability on someone who did not contribute to somebody else's damage. My amendment would make it clear, and I will just read one paragraph from my amendment: That nothing in this act shall be construed to prohibit a civil liability action from being brought or continued against a person if the gross negligence or reckless conduct of that person was a proximate cause of death or injury.…
