Because the Justice Department has set forth the ambiguity in the words ``failure to comply.'' The question is whether or not those words refer to the procedural irregularities which could occur in the cost-benefit analysis or in the risk assessment. Their letter dated July 11, 1995, is a pretty serious source, the Justice Department. They say on page 2 in a letter to Senator Dole that there remain two basic problems which create the potential for litigation under section 625. First, section 625 provides that failure to comply--they underline the words ``with the.'' They now substitute the words ``the rules pertaining to cost-benefit and risk analysis.''
