Section 1022 applies only to a person who is ``a member of, or part of, al-Qaeda or an associated force that acts in coordination with or pursuant to the direction of al-Qaeda.'' The statement of managers states that this language intentionally excluded the Taliban. Would the Senator agree with me that the requirements of section 1022--including the transfer restrictions applicable under that provision--do not apply to individuals detained by our forces in Afghanistan?
