I have been reluctant to put the Federal Government in the position of judging the appropriateness of a binding arbitration clause in a private contract. However, I will support the amendment because I believe that in the case, the relative ability of parties to negotiate contract provisions are particularly uneven. My vote should not be interpreted as an indication of my position on future legislation that may be offered on the subject of the Federal Government overriding binding arbitration clauses. I would like to ask the sponsor of the amendment, my colleague from Wisconsin, whether, under this amendment, either party to a contract that contains a binding arbitration clause can choose alternatively to go to court to resolve the dispute.
