Mr. Chairman, I have an amendment at the desk. The CHAIR. The Clerk will designate the amendment. The text of the amendment is as follows: In section 132(c) of the Clean Air Act, as proposed to be added by section 3 of the bill, strike ``and'' at the end of paragraph (1), strike the period at the end of paragraph (2) and insert ``; and'', and add at the end the following paragraph: ``(3) the term `nuisance dust' does not include any particulate matter produced from mining activities. The CHAIR. Pursuant to House Resolution 487, the gentleman from California (Mr. Waxman) and a Member opposed each will control 5 minutes. The Chair recognizes the gentleman from California.
