Over 20 years ago, the people of California enacted a landmark ballot measure known as proposition 65. Proposition 65 prohibits exposures to chemicals like lead that are known to cause cancer or reproductive harm without a clear and reasonable warning. Proposition 65 enforcement actions by the State and by private attorney generals have played a crucial role in reducing childhood exposure to harmful chemicals, such as lead. For example, the California attorney general recently brought a proposition 65 case arising from unsafe levels of lead in children's toys. It is my understanding that nothing in this bill is intended to preempt or otherwise diminish the protections of proposition 65.
