I want to point our that the gentleman's premise is what I believe is incorrect in this debate. There is nothing in this bill that changes the law as to when a search warrant is needed or is not needed. It deals only with those situations where, when a search is made without a warrant, if there was a good-faith error, then the evidence can be considered. It expands an exception that already exists in the law for search warrants. In all of the examples the gentleman from Missouri has given, he has described anything but good faith. Therefore, there is not protection to honest citizens by the gentleman's amendment. Honest citizens, in fact, are not even protected by the exclusionary rule. If a law enforcement officer wants to go through that door, with the power of his immediate armament, and seize something, he or she is going to do it. If so, the exclusionary rule is not going to stop them, because that is an after-the-fact determination when someone is believed to be guilty.
