I see Senator Enzi is here, and I appreciate his patience in allowing me to go ahead, but I know if I were still the Governor of Tennessee--which I am not, and I won't be again--and Congress did not act on this and I saw an opportunity--if I looked across my State and I saw that our tax laws treated some taxpayers one way and other taxpayers a different way and instate businesses one way and out-of-State businesses better, it wouldn't take me 20 minutes to call the attorney general over and say: Let's take this case to court. Let's go back to court. If somebody is going to sell in Tennessee, they are going to collect the tax. I believe I would have a reasonably good chance of winning. And I am confident that, knowing a number of the Governors around this country, if we fail to act, I will bet one of them will be in court the next day. I congratulate Senator Durbin and Senator Enzi for their persistence in creating what is an 11-page bill about two words--States rights-- that will--my prediction--allow many States to lower their tax rates when they collect taxes that are already owed but not paid and treat businesses the same way and taxpayers the same way.
