The senior assistant legislative clerk read as follows: The Senator from Tennessee [Mr. Alexander], for Mrs. Fischer, proposes an amendment numbered 2079 to amendment No. 2089. The amendment is as follows: (Purpose: To ensure local governance of education) On page 800, between lines 17 and 18, insert the following: SEC. 9115A. LOCAL GOVERNANCE. Subpart 2 of part F of title IX (20 U.S.C. 7901 et seq.), as amended by sections 4001(3), 9114, and 9115, and redesignated by section 9106(1), is further amended by adding at the end the following: ``SEC. 9540. LOCAL GOVERNANCE. ``(a) Rule of Construction.--Nothing in this Act shall be construed to allow the Secretary to-- ``(1) exercise any governance or authority over school administration, including the development and expenditure of school budgets, unless otherwise authorized under this Act; ``(2) issue any regulation without first complying with the rulemaking requirements of section 553 of title 5, United States Code; or ``(3) issue any non-regulatory guidance without first, to the extent feasible, considering input from stakeholders. ``(b) Authority Under Other Law.--Nothing in subsection (a) shall be construed to affect any authority the Secretary has under any other Federal law.''.
