On Monday, March 21, 1994, we passed the Senate version of the Marine Mammal Protection Act reauthorization bill. The House passed a similar version of the legislation, H.R. 2760, that same day. Senator Kerry's staff and my staff worked with the House staff Monday night to bring the bills even closer together, and Tuesday the House took up our bill, S. 1636, inserted the product of the meeting between our staffs, and passed S. 1636 under suspension. Over the past 2 days, Senator Kerry and I have reviewed the revised S. 1636. With two exceptions, the bill we are sending back to the House today contains only technical changes. We learned yesterday that there were serious concerns about the new definition of ``harm'' included by the House in the revised version of S. 1636. We have removed the definition of ``harm'' from the bill because the term ``harm'' has been the subject of a recent U.S. Court of Appeals decision involving the Endangered Species Act, because the Committee has not adequately addressed the implications of defining ``harm,'' and because the definition is not an integral part of the new marine mammal/commercial fisheries regime.
