The amendment simply allows the States to have the authority that the Department of Transportation determined 5 years ago that they had under that existing transportation law. We just want to make sure that in the legislation we are considering today we do not change that. If it is determined that that is in violation of the Constitution, certainly they will be the governing decision, but if it is not determined, we do not want anything in this law to preclude those States' rights. With that, I ask support for my amendment.
