I would certainly interpret ``person'' narrowly to mean only an awardee institution and not its affiliates or subcontractors. Similarly, we would not view contracts that receive funding under the Federal acquisition regulation procedures for noncompetitive procurements as ``not subjected to a competitive, merit- based award process.''
