The conferees expect State programs to provide access to appropriate treatment for special needs children. In addition, the new legislation is clear that children who are eligible for Medicaid under current law may not be shifted to the new program under title XXI. Medicaid coverage may not be rolled back and replaced by new insurance programs. For example, the new program cannot replace an existing medically needy program for children or existing Medicaid eligibility through waivers for children receiving home and community based care.
