If the trial by jury were reestablished, the Common Law principle of taxation would be reestablished with it; for it is not to be supposed that juries would enforce a tax upon an individual which he had never agreed to pay.
He believes that reestablishing trial by jury would also restore the principle of consent in taxation.

Why should they not have such an administration of justice as they desire, and can understand?
The presumption clearly is that all were eligible.
In that case the trial is really a trial by the government, and not by the jury.
